These Terms of Use ("Terms") form a binding agreement between you and MexStreamz ("we", "us", "our") governing your access to and use of our website, applications, and video streaming services (the "Service"). Please read them carefully. By accessing the Service or creating an account, you agree to be bound by these Terms and our Privacy Policy.
1. Acceptance of Terms
If you do not agree to these Terms, you must not access or use the Service. If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the permission and supervision of a parent or legal guardian, who accepts these Terms on your behalf. You confirm that the information you give us is accurate and that you are legally able to enter into this agreement.
3. Your Account
Some features require an account. You are responsible for keeping your credentials confidential and for all activity under your account. You must notify us promptly through the Support page if you suspect unauthorised access. We may suspend or terminate accounts that provide false information, are used to breach these Terms, or pose a risk to the Service or other users.
4. Use of the Service
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view content made available through the Service for your own lawful, non-commercial use. All rights not expressly granted are reserved.
5. Acceptable Use
You agree that you will not:
- Violate any applicable law or regulation, or infringe the rights of any person.
- Copy, download, record, redistribute, publicly perform, or otherwise exploit videos or other content, except where the Service expressly permits it.
- Circumvent, disable, or interfere with security, access controls, or streaming protections.
- Use bots, scrapers, or automated tools to access the Service or extract content or data.
- Attempt to gain unauthorised access to accounts, systems, or networks connected to the Service.
- Upload or transmit malware, or engage in activity that disrupts or degrades the Service.
- Harass, threaten, impersonate, or abuse other users or our staff.
- Post comments that are unlawful, defamatory, hateful, sexually explicit, deceptive, or that infringe others' rights.
- Submit false, misleading, or abusive support tickets, or flood support with duplicate requests.
6. User Content and Comments
You retain ownership of the comments and other material you submit ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, and distribute it in connection with operating and promoting the Service. You represent that you have all rights necessary to submit it and that it does not violate these Terms or any law. We may review, edit, hide, or remove User Content at our discretion, including where it breaches these Terms.
7. Intellectual Property
The Service and its content, including videos, text, graphics, logos, software, and design, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
8. Copyright Complaints
We respect intellectual property rights. If you believe content on the Service infringes your copyright, open a ticket on our Support page with the subject "Copyright complaint", identify the work you believe is infringed, provide the location of the material, and include your contact details and a statement that you are authorised to act. We may remove content and restrict repeat infringers.
9. Availability and Changes to the Service
We aim to provide a reliable Service, but it is provided on an "as available" basis. We may modify, suspend, or discontinue any part of the Service, including content, features, and playback quality, at any time, with or without notice. We are not liable for any interruption, delay, or loss caused by maintenance, technical failures, or events beyond our reasonable control.
10. Support
Support is provided through the ticketing system on our Support page. Our team responds during working hours, Monday to Friday, excluding weekends and public holidays, and aims to reply within two business days (48 working hours). Response times are targets and not guarantees.
11. Third-Party Links and Services
The Service may contain links to, or rely on, third-party websites and services. We do not control them and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk.
12. Disclaimers
To the fullest extent permitted by law, the Service and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
13. Limitation of Liability
To the fullest extent permitted by law, we and our directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars. Nothing in these Terms excludes liability that cannot be excluded by law.
14. Indemnification
You agree to indemnify and hold us harmless from claims, liabilities, damages, and expenses, including reasonable legal fees, arising from your breach of these Terms, your User Content, or your misuse of the Service.
15. Suspension and Termination
We may suspend or terminate your access at any time, with or without notice, if we believe you have breached these Terms or that your use creates risk or legal exposure. You may stop using the Service at any time. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.
16. Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. The parties will first attempt to resolve any dispute in good faith through our Support page. If a dispute cannot be resolved informally, it will be subject to the exclusive jurisdiction of the competent courts of Nigeria, except where mandatory consumer laws in your country of residence give you the right to bring proceedings elsewhere.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, give additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
18. General Provisions
These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
